- These Terms of Use outline the conditions for accessing and utilizing the funcode.hu marketplace.
- The Operator offers an independent information intermediary service within the Marketplace, separate from the Seller, and does not participate in any commercial activities.
- These Terms of Use do not specifically apply to the sale of tickets and related services or products offered by individual Sellers. The Operator explicitly emphasizes to Users that funcode.hu functions as a marketplace where the actual sale of tickets creates a legal relationship between the customer and the Seller(s), who are legal entities responsible for the sales of individual events. Showtrade Kft., in its capacity as the operator of the funcode.hu Marketplace, does not participate in any commercial activities through the platform.
- Each Seller is obligated to publish its own General Terms and Conditions concerning the sale of tickets for events advertised on the Marketplace. These Terms must be prominently displayed in the footer of the relevant subpage(s) associated with each Seller. They regulate the Seller’s provisions related to the sale of individual tickets, including the ticket ordering process, any required registration for purchases, order fulfillment, the details regarding withdrawal from an order, and the rights and obligations of buyers during the purchasing process. The Operator stipulates in its contracts with Sellers that they must promote their General Terms and Conditions related to ticket sales and Privacy Policies in a manner that is accessible to buyers. The Seller is solely responsible for the existence, content, necessary updates, and ensuring that its commercial activities align with its General Terms and Conditions and the advertised Privacy Policy. The Operator assumes no liability for these matters or their absence. Additionally, the Seller bears full responsibility for its operations, which include, but are not limited to, the information presented about the events and tickets offered, the ticket prices, the sales fees charged by the Sellers, the management of purchase transactions and issued tickets, as well as the buyers’ right to withdraw.
- Throughout its operations, the Operator serves as an information service provider, facilitating the sale of events, tickets, and related services and products offered by various Sellers. This is accomplished by collecting relevant information and making it accessible to Users via the funcode.hu Marketplace.
- The Operator displays the events and tickets available for sale through the funcode.hu Marketplace in a manner that clearly identifies the Seller responsible for offering the tickets, ensuring that their identity is unmistakably recognized.
- Users can access a list of events available on the funcode.hu Marketplace landing page, organized according to various criteria. The Operator retains the exclusive authority to establish these display criteria.
- Users can click on the event of interest to navigate to its dedicated subpage within the Marketplace, where detailed information about the event is provided.
- Users can search for specific events within the Marketplace by utilizing various filtering criteria, which can be accessed through the marketplace's search functions.
- Users can express their intention to purchase tickets either on the Marketplace landing page or by clicking the 'Buy Tickets' button on the event's subpage. By selecting the 'Buy Tickets' button, users will be redirected to the Seller's Webshop, where the Seller will handle the actual sales of the Event. From this point onward, the sale of tickets is conducted by the Seller in accordance with its own advertised Terms and Conditions, and ticket sales are not associated with the Operator in any way.
- The content, ticket prices, data, and information displayed on the Marketplace, which may relate to Events, are subject to change due to the nature of the service. The Operator will make every effort to provide the most current information on the Marketplace. However, since the information presented on the Marketplace, including the list of Events, their descriptions, and ticket prices, originates from the Sellers and is managed by them, the Operator cannot be held responsible for the accuracy, timeliness, or availability of this content and will not be liable for any compensation related to these matters.
- The Operator emphasizes to Users that the information displayed on the Marketplace (including, but not limited to, details regarding ticket availability and prices) is for reference purposes only and may differ from the information available on the individual Seller's Webshop, as well as on other platforms used during sales. In such instances, the information provided by the Seller will take precedence.
- The Operator shall not be held liable for any invitations, offers, or contracts made on the Marketplace and/or on the individual Seller's Webshop that do not originate from it, nor for their non-existence or termination. This includes, but is not limited to, the accuracy, quality, and usability of issued tickets, as well as the quality, safety, and legal compliance of the Events. The Operator is not obligated to verify these aspects and will not assume responsibility for their correctness. Additionally, the Operator will not mediate or intervene in any consumer disputes or transactions between customers and Sellers or Event Organizers, nor will it have the capacity to do so in the absence of legal and/or contractual obligations.
- The Operator does not require User registration to access the Marketplace or browse the events presented. However, the Seller may choose to require customer registration for the actual purchase of tickets. In such cases, the registration terms and conditions will be outlined in the Seller's General Terms and Conditions for ticket purchases.
- The Operator provides the funcode.hu marketplace operating service to Users free of charge. During the actual ticket purchase, the ticket price and any additional fees that buyers may pay, such as participation or ticket issuance fees, are paid directly to the Seller. The Operator is not a party to these transactions and does not engage in any contractual relationship regarding them.
- The dispatch, delivery, transfer, and after-sales handling of tickets sold in the Webshop to customers are conducted independently of the Operator, in accordance with the agreements made between the Sellers and the customers. The Operator shall not be held liable for any errors that may arise in this process.
- The trademarks and logos displayed on the Marketplace in relation to funcode.hu are the exclusive property of the Operator, except for universal logos that are commonly used and not owned by a specific rights holder. These marks may not be used, copied, distributed, or published by third parties without the Operator's explicit prior written consent.
- The User acknowledges and agrees that the images, articles, texts, videos, and graphics related to the events displayed on the Marketplace are or may be protected by copyright. These rights belong to the Seller or the rights holders who have authorized the Seller to use the Marketplace. Any information and event-related materials available on the Marketplace may not be used, copied, distributed, or published by third parties for purposes beyond those of the Marketplace without the explicit prior written consent of the Seller or the rights holders.
- The content, trademarks, images, videos, audio material, text, and other digital content related to each event are provided by the respective Seller to the Operator and are displayed on the Marketplace in their original, unchanged form. The Operator does not alter, reduce, or modify this material and assumes no responsibility for it under its agreements with the Sellers. As such, the Operator does not verify the authenticity or ownership of the rights to this content. Any claims or objections regarding this material should be directed to the Seller responsible for the event, as the Operator disclaims any liability in this regard.
- Users can reach the Operator of the Marketplace via the contact information provided on the 'Contact Us' page, located in the footer of the Marketplace.
- Users/Customers can reach Sellers through the contact options provided in the footer of the respective Seller's subpage. The Seller is responsible for the accuracy and reliability of the contact information provided, as well as for any customer service communications conducted through their channels.
- If the Operator detects unusually high traffic from a specific Internet network, it reserves the right to implement a 'captcha' verification for Users and customers accessing the Marketplace. The Operator may also restrict or block access to Users or customers whose actions threaten the smooth functioning of the Marketplace or pose a risk of harm to the Operator.
- FORCE MAJEURE. This refers to any unforeseen, uncontrollable event or circumstance beyond the Operator's control that affects its ability to carry out its obligations under these Terms of Use. In the event of non-performance or inadequate performance due to force majeure, the Operator shall not be held liable.
- The Operator will not process any personal data related to individuals in connection with the operation of the Marketplace, in compliance with Regulation 2016/679 of the European Parliament and of the Council (GDPR).
- Each Seller's privacy policy is available in the footer of their respective Webshop.
- The Operator utilizes cookies, which are small text files stored on the User's computer, to ensure the proper functioning of the Marketplace, facilitate service enhancements, and improve the overall user experience. Users can adjust their cookie settings within their browser preferences. While refusing cookies does not prevent their use, it may affect the functionality of certain elements of the Marketplace. Additionally, session cookies do not collect any information that could identify the User.
- To enhance the efficiency of the Marketplace and monitor relevant user diagnostics, the Operator employs Google Tag Manager on the Marketplace pages. Aside from the information included in the standard log of http requests and specific diagnostic data, the Tag Manager used on the Marketplace does not collect, store, or share any data related to Users.
- These Terms of Use shall take effect upon publication on the main page and will remain in effect indefinitely. Their content is governed by Hungarian law and applicable European Union regulations.
- The Operator reserves the right to unilaterally modify these Terms of Use. In such instances, the Operator will publish the revised version on the Marketplace pages and provide a downloadable version of the Terms of Use that have been in effect for the past 180 days, even if they have been superseded.
